Major Monthly & Quarterly Giveaways (‘MQG’ & 'MMG')

1. General Terms and Conditions

1.1. These Terms and Conditions as applicable to each Major Quarterly Giveaway (the ‘MQG Terms’) and each Major Monthly Giveaway (the ‘MMG Terms’) are to be read in conjunction with the general terms and conditions (the ‘Terms’) as posted on the Loyalty Suite Website (the ‘Website’) available at https://www.loyaltysuite.app/terms-and-conditions, as amended from time to time.

1.2. Both MMG and MQG Terms, without limiting or foregoing any of the Terms, shall govern and apply to this particular giveaway and entry into a draw for this or any other giveaway conducted by and/or a third-party affiliate, from time-to-time, constitute your acceptance and agreement to be bound by the Terms and the Major Monthly and Major Quarterly Giveaway Terms.

1.3. Each MMG and MQG is, or may be, conducted by Shire Talk NSW Pty LTD ABN 93 649 550 103 c/o - Jeffrey Todd and Associates, Suite 3/11 Forest Road, Hurstville NSW 2200, under the provisions of the Community Gaming Act 2018 and the Community Gaming Regulation 2020 (‘Lottery Acts’), license number GOCLP-1044.

1.4. Services as defined in the Terms are provided by Shire Talk NSW Pty Ltd ABN 93 649 550 103; c/o- Jeffrey Todd and Associates, Suite 3/11 Forest Road, Hurstville NSW 2200;
1.5 Marketing Agencies, Shire Talk and Destination Shoalhaven. Shire Talk and Destination Shoalhaven have reserved the right (in conjunction with us, Loyalty Suite) to regularly promote and advertise each one of our loyalty rewards apps (Shire Rewards, Shoalhaven Rewards), every MMG and every MQG to their databases, local community, social followers, both online and offline.

1.7. Photographs and images on our Websites or associated Loyalty Rewards Apps (the ‘Apps’) are for illustration purposes only and may not depict the actual giveaway prize. In the event a prize is not available, for any reason, at the time of the draw, each of our associated marketing agencies (Shire Talk, Destination Shoalhaven) reserves the right to issue a replacement giveaway prize of a similar type and value. In the event a replacement giveaway prize of a similar type is not available at the time of the draw, each associated marketing agency (Shire Talk, Destination Shoalhaven) reserves the right to issue a replacement giveaway prize/s of a similar value, at their sole discretion.

1.8. All taxes, duties, levies, government charges, and liabilities associated with a giveaway prize are the sole responsibility and liability of the giveaway prize draw winner (the ‘Winner’).

1.9. All decisions relating to the prize/s giveaway made by our associated marketing agencies (Shire Talk, Destination Shoalhaven) are final, made at the sole discretion of each associated marketing agency (Shire Talk, Destination Shoalhaven), and are non-negotiable. Each associated marketing agency (Shire Talk, Destination Shoalhaven) will not enter into correspondence with any party, including but not limited to eligible giveaway prize Winners, or entrants into any monthly or quarterly giveaway, including but not limited to any monthly or quarterly giveaway for any reason other than to communicate the outcome of a draw or to communicate with a Winner directly so that the Winner may make arrangements to collect their giveaway prize.

1.10. Each prize, competition, contest and or giveaway hosted by each associated marketing agency (Shire Talk, Destination Shoalhaven) is not sponsored, endorsed, administered by, or otherwise associated with Facebook (Meta), Apple or Google Play.

1.11. All monthly giveaway prize draws are Member’s monthly draws and will be conducted on a monthly basis and are not subject to a minimum or maximum number of entries. For the avoidance of doubt, giveaway prize draws will be held each quarter on the advertised drawing date irrespective of the number of entries into that draw as at that date.

1.12. All quarterly giveaway prize draws are Member’s quarterly draws and will be conducted on a quarterly basis and are not subject to a minimum or maximum number of entries. For the avoidance of doubt, giveaway prize draws will be held each quarter on the advertised drawing date irrespective of the number of entries into that draw as at that date.

2. Eligibility

2.1. Each giveaway is only open to individuals, whom, without foregoing any of the eligibility criteria contained in the Terms, are, at the time of entry:

(a) a resident of Australia;

(b) at least 18 years of age;

(c) registered as a Silver Shire Rewards or Shoalhaven Rewards Member and/or a Shire Rewards or Shoalhaven Rewards Perks Club Member in accordance with the Terms;

(d) not prohibited from receiving the giveaway prize by law, mandate, or any other reason which would preclude them from being able to collect the giveaway prize within the prize claim period; and

(e) are not an employee, residing with an employee, a spouse, de-facto spouse, parent, child, or sibling (whether full, half, step, or by adoption) of an employee of each associated marketing agency (Shire Talk, Destination Shoalhaven), an agency associated with each giveaway or the giveaway prize; or any of their related bodies corporate.

(f) Able to travel during proposed travel dates.

3. Entry

3.1. Depending on the location of each loyalty rewards app (Shire Rewards, Shoalhaven Rewards) each associated marketing agency (Shire Talk, Destination Shoalhaven) will announce each giveaway to via their Website, social media platforms, and direct marketing, and will, announce the winner of each giveaway to Members via the App, SMS (text) message, or email. Each associated marketing agency (Shire Talk, Destination Shoalhaven) is not obligated to ensure Members receive announcements or communication regarding a current or upcoming giveaway, but will make every effort using the above methodology to notify Members generally of the winner, in addition to direct email correspondence and/or telephone call to the Winner via the contact information the Winner provided, as updated by the Member, from time-to-time, when they registered as a Member of Shire Rewards or Shoalhaven Rewards Platform (‘Member Information’).

3.2. Entries into a MMG can be earned or purchased commencing the 1st of each month, and entries must close for the MMG at 11:59 pm on the last of each month (MMG Entry Period’) Single entries into an MMG from any new Shire Rewards or Shoalhaven Rewards account creation will expire at the end of the month in question.

3.3. Entry into a MMG can only be made by Eligible Members (see the Terms) via the App, and/or Website (from time to time). There are no means of entry into the MMG via paper ballot, mail in ballot, email, skill testing competition, or direct contact with each associated marketing agency (Shire Talk, Destination Shoalhaven).

3.4. Entries into a MQG can be earned or purchased commencing on the 1st day of each quarter, and entries must close for the MQG at 11:59 pm on the last day of the month of the last month of the quarter (‘MQG Entry Period’).

3.5. Entry into a MQG can only be made by Eligible Members (see the Terms) via the App, and/or Website (from time to time). There are no means of entry into the MQG via paper ballot, mail in ballot, email, skill testing competition, or direct contact with each associated marketing agency (Shire Talk, Destination Shoalhaven)

3.6. From time to time, Eligible Members may be able to earn additional entries into a quarterly giveaway by participating in special promotions or activities as outlined on the Website, communicated to Members via email marketing, or within our loyalty rewards apps. Opportunities to earn additional entries are not guaranteed, are subject to availability and are at the sole discretion of each associated marketing agency (Shire Talk, Destination Shoalhaven) and may be amended or revoked at any time, without notice or liability.

3.7. Eligible Members may purchase additional entries into a quarterly giveaway via the Website or the App (‘Purchase(d) Entries’). There is no limit to the number of entries or special entry packages that an Eligible Member may purchase, subject to any limitations imposed by law, legal ordinance, or the direction of a government body with regulatory authority in accordance with the Lotteries Act and/or responsible gaming. Each associated marketing agency (Shire Talk, Destination Shoalhaven) shall not be liable for any loss, damage or injury incurred by a party in connection with the purchase of entries into a quarterly giveaway, not foregoing any and all other limitations of liability contemplated in the MQG Terms and the Terms generally.

3.8. Eligible Members may obtain Purchase Entries into the MQG, in addition to any other means by which a Member may be able to or eligible to earn an Entry, as follows:

(a) 40 additional entries for $49.00 AUD and can be purchased at the checkout or from the website;

3.9. Purchased entries expire at the end of each MQG Entry Period, upon the draw and announcement of the Winner. For the avoidance of doubt, Purchased Entries for giveaways shall not carry forward or be entered into a subsequent quarterly giveaway draw, unless, and only by operation of clause 15 herein or otherwise where contemplated by the MQG Terms or the Terms generally.

4. Notification and Claiming your Prize

4.1. Notifications and attempts to notify the Winner of each giveaway will be made using the Member Information as currently associated to the Winner’s Member account. A failure to maintain accurate and/or current Member Information may result in delays in notification to a prize Winner.

4.2. The Winner will be announced or otherwise notified that they have won via announcement on the Website, the App, or our associated social media accounts as well as by email and telephone call. Giveaway entrants (‘Entrants’) are responsible for monitoring the Website, their member account, their email inbox (including the spam and/or junk folder) and their SMS messages or voicemails and/or our associated social media accounts for the Winner announcement. Each associated marketing agency (Shire Talk, Destination Shoalhaven) cannot guarantee that a Winner will be notified by email, telephone call, SMS (text) message or via some other form of direct communication if the Winner has failed to update their Member Information. Each associated marketing agency (Shire Talk, Destination Shoalhaven) will contact the Winner using at least two of the above listed means of notification as well as posting the name of the winner on the Website and within each loyalty rewards app. The Winner may contact [email protected] or [email protected] to confirm their acknowledgement of being drawn and must undertake a verification of identity and eligibility prior to receiving their prize.

4.3. If you have been drawn as a quarterly prize winner and have not received or cannot locate an email or other direct correspondence that provides you with instructions and/or information as to how to claim your prize, you must contact us directly at [email protected] or [email protected] advising us you wish to claim your prize and follow any subsequent instructions regarding the steps you must take in order to establish your entitlement to the prize.

4.4. Each associated marketing agency (Shire Talk and/or Destination Shoalhaven) reserves the right to verify your eligibility and to confirm your identity, at their sole discretion and to their sole satisfaction, prior to releasing any quarterly giveaway prize to any Winner. Decisions regarding eligibility are final and is at the sole discretion of each associated marketing agency (Shire Talk and/or Destination Shoalhaven).

4.5. You may be disqualified from receiving a quarterly giveaway prize, at the sole discretion of each associated marketing agency (Shire Talk and/or Destination Shoalhaven) if it is found or suspected in good faith, that you are or have become ineligible to receive a quarterly giveaway prize or have breached these (the MQG Terms), or any of the Terms you agreed to be bound by in connection with your Membership or use of the Service(s), Website, or App.

5. Unclaimed Prizes

5.1. Each associated marketing agency (Shire Talk and/or Destination Shoalhaven) is obligated to comply with the conditions of any gaming or lottery license they hold and the provisions of the applicable legislation (Lottery Acts) as described in clause 1.3 herein.

5.2. The announced Winner must claim their prize within three (3) months of the draw date of that prize’s associated quarterly giveaway.

5.3. In New South Wales, in accordance with the respective legislation (as described in clause 1.3 herein), if the announced Winner does not claim their prize within three (3) months of the draw date of that prize’s associated quarterly giveaway, each associated marketing agency (Shire Talk and/or Destination Shoalhaven) may apply to the New South Wales office of Fair Trading detailing the measures taken to contact the Winner and/or deliver the giveaway prize to the winner, or otherwise cause for the prize to be delivered to the winner, and seek the permission of the office of Fair Trading to sell the prize. Once each associated marketing agency (Shire Talk and/or Destination Shoalhaven) has received the written approval in accordance with the applicable legislation, each associated marketing agency (Shire Talk and/or Destination Shoalhaven) may sell or otherwise deal with the giveaway prize in any compliant manner they see fit, and retain any funds derived from such sale and/or dealing.

6. Cancellation and Refund Policy

6.1. Purchased ballots may not be cancelled or refunded for change of mind, termination of your Membership or Subscription, however caused, or for any reason other than as required at law or by way of complete cancellation of the quarterly giveaway, at the sole discretion of Each associated marketing agency (Shire Talk and/or Destination Shoalhaven). 6.2. In the event a monthly or quarterly giveaway is cancelled for reasons beyond the reasonable control of each associated marketing agency (Shire Talk and/or Destination Shoalhaven), including but not limited to acts of God, force majeure, or restrictions of availability, entries into the draw, whether earned via your Perks Club Member benefits, or purchased individually or as a part of your paid subscription, will be carried forward and entered into the next monthly/quarterly draw. Entrants may not make any claim against either of our associated marketing agencies (Shire Talk and/or Destination Shoalhaven), for a cancelled monthly or quarterly draw on any basis, including but not limited to legal theories such as loss or reduction of opportunity, loss or reduction of chance, or any such related legal concepts.

6.3. In the event a monthly or quarterly giveaway is cancelled, and no subsequent quarterly giveaway is scheduled, and the cumulative value of all quarterly giveaways awarded to a Winner has not met or exceeded $30,000.00 AUD by the quarter within which the cancelled quarterly giveaway (‘Cancelled Giveaway’) has occurred, entrants whom have purchased entries or an entry package into the Cancelled Giveaway will be refunded the value of that purchase by the date at which the subsequent quarterly giveaway to the Cancelled Giveaway would have been drawn.

6.4. For the avoidance of doubt, purchased entries or purchased entry packages do not include entries received by Members as part of the benefits a Member receives in connection with a paid Membership subscription. Only entries or entry packages purchased where no other consideration is received by the purchaser other than entries into a giveaway draw (‘Purchased Entries’) are entries or entry packages that will be eligible for a refund in the event of a Cancelled giveaway, subject to the terms and conditions contained herein.

7. Privacy Policy

7.1. Loyalty Suites comprehensive privacy policy may be located on the website https://www.loyaltysuite.app/privacy-policy. Each associated marketing agency (Shire Talk and/or Destination Shoalhaven)’s comprehensive privacy policy may be located on the Website at https://destinationshoalhaven.com.au/privacy-policy/ and https://www.shiretalk.com.au/privacy-policy/

7.2. Nothing in these Terms shall forego any of the terms and condition of privacy as outlined in the Terms and our Privacy Policy. Notwithstanding the Terms and our Privacy Policy, you consent to:

(a) receiving direct marketing material from each associated marketing agency (Shire Talk and/or Destination Shoalhaven);

(b) having your name published on our Website, in direct marketing material, on the App, and any social media pages if you are an eligible Giveaway Prize Winner;

(c) having your photo taken and utilised for marketing purposes if you are an eligible Giveaway Prize Winner, including but not limited to that photography being utilised in future direct marketing materials, on the Website, App, promotional materials, digital or otherwise; and

(d) any such photography of a Giveaway Prize Winner shall be the sole intellectual property of each associated marketing agency (Shire Talk and/or Destination Shoalhaven) and Giveaway Prize Winners shall have no claim, legal, moral, or otherwise in such intellectual property.

7.3. Each associated marketing agency (Shire Talk and/or Destination Shoalhaven) respects your right to privacy and takes the privacy rights of individuals and businesses seriously. For questions or concerns regarding our Privacy Policy or Giveaway Privacy Policy, collectively (the ‘Privacy Policies’), or to withdraw your consent to the terms and conditions of the Privacy Policies, please write to us at [email protected] specifically outlining your query or concern.

7.4. Please note, that in accordance with the Giveaway Terms and each associated marketing agency (Shire Talk and/or Destination Shoalhaven)’s Terms, a withdrawal of your consent to be bound by the Privacy Policies shall render you ineligible to participate in any draw or giveaway and may result in the suspension, cancellation, or limitation of your access to the Website, Service(s), the App, Membership, or your subscription at the sole discretion of each associated marketing agency (Shire Talk and/or Destination Shoalhaven).

Each associated marketing agency (Shire Talk, Destination Shoalhaven) cannot guarantee that a Winner will be notified by email, telephone call, SMS (text) message or via some other form of direct communication if the Winner has failed to update their Member Information. Each associated marketing agency (Shire Talk, Destination Shoalhaven) will contact the Winner using at least two of the above listed means of notification as well as posting the name of the winner on the Website and within each loyalty rewards app. The Winner may contact [email protected] or [email protected] to confirm their acknowledgement of being drawn and must undertake a verification of identity and eligibility prior to receiving their prize.

4.3. If you have been drawn as a quarterly prize winner and have not received or cannot locate an email or other direct correspondence that provides you with instructions and/or information as to how to claim your prize, you must contact us directly at [email protected] or [email protected] advising us you wish to claim your prize and follow any subsequent instructions regarding the steps you must take in order to establish your entitlement to the prize.

4.4. Each associated marketing agency (Shire Talk and/or Destination Shoalhaven) reserves the right to verify your eligibility and to confirm your identity, at their sole discretion and to their sole satisfaction, prior to releasing any quarterly giveaway prize to any Winner. Decisions regarding eligibility are final and is at the sole discretion of each associated marketing agency (Shire Talk and/or Destination Shoalhaven).

4.5. You may be disqualified from receiving a quarterly giveaway prize, at the sole discretion of each associated marketing agency (Shire Talk and/or Destination Shoalhaven) if it is found or suspected in good faith, that you are or have become ineligible to receive a quarterly giveaway prize or have breached these (the MQG Terms), or any of the Terms you agreed to be bound by in connection with your Membership or use of the Service(s), Website, or App.

5. Unclaimed Prizes

5.1. Each associated marketing agency (Shire Talk and/or Destination Shoalhaven) is obligated to comply with the conditions of any gaming or lottery license they hold and the provisions of the applicable legislation (Lottery Acts) as described in clause 1.3 herein.

5.2. The announced Winner must claim their prize within three (3) months of the draw date of that prize’s associated quarterly giveaway.

5.3. In New South Wales, in accordance with the respective legislation (as described in clause 1.3 herein), if the announced Winner does not claim their prize within three (3) months of the draw date of that prize’s associated quarterly giveaway, each associated marketing agency (Shire Talk and/or Destination Shoalhaven) may apply to the New South Wales office of Fair Trading detailing the measures taken to contact the Winner and/or deliver the giveaway prize to the winner, or otherwise cause for the prize to be delivered to the winner, and seek the permission of the office of Fair Trading to sell the prize. Once each associated marketing agency (Shire Talk and/or Destination Shoalhaven) has received the written approval in accordance with the applicable legislation, each associated marketing agency (Shire Talk and/or Destination Shoalhaven) may sell or otherwise deal with the giveaway prize in any compliant manner they see fit, and retain any funds derived from such sale and/or dealing.

6. Cancellation and Refund Policy

6.1. Purchased ballots may not be cancelled or refunded for change of mind, termination of your Membership or Subscription, however caused, or for any reason other than as required at law or by way of complete cancellation of the quarterly giveaway, at the sole discretion of Each associated marketing agency (Shire Talk and/or Destination Shoalhaven). 6.2. In the event a monthly or quarterly giveaway is cancelled for reasons beyond the reasonable control of each associated marketing agency (Shire Talk and/or Destination Shoalhaven), including but not limited to acts of God, force majeure, or restrictions of availability, entries into the draw, whether earned via your Perks Club Member benefits, or purchased individually or as a part of your paid subscription, will be carried forward and entered into the next monthly/quarterly draw. Entrants may not make any claim against either of our associated marketing agencies (Shire Talk and/or Destination Shoalhaven), for a cancelled monthly or quarterly draw on any basis, including but not limited to legal theories such as loss or reduction of opportunity, loss or reduction of chance, or any such related legal concepts.

6.3. In the event a monthly or quarterly giveaway is cancelled, and no subsequent quarterly giveaway is scheduled, and the cumulative value of all quarterly giveaways awarded to a Winner has not met or exceeded $30,000.00 AUD by the quarter within which the cancelled quarterly giveaway (‘Cancelled Giveaway’) has occurred, entrants whom have purchased entries or an entry package into the Cancelled Giveaway will be refunded the value of that purchase by the date at which the subsequent quarterly giveaway to the Cancelled Giveaway would have been drawn.

6.4. For the avoidance of doubt, purchased entries or purchased entry packages do not include entries received by Members as part of the benefits a Member receives in connection with a paid Membership subscription. Only entries or entry packages purchased where no other consideration is received by the purchaser other than entries into a giveaway draw (‘Purchased Entries’) are entries or entry packages that will be eligible for a refund in the event of a Cancelled giveaway, subject to the terms and conditions contained herein.

7. Privacy Policy

Each associated marketing agency (Shire Talk and/or Destination Shoalhaven)’s comprehensive privacy policy may be located on the Website at https://destinationshoalhaven.com.au/privacy-policy/ and https://www.shiretalk.com.au/privacy-policy/

7.2. Nothing in these Terms shall forego any of the terms and condition of privacy as outlined in the Terms and our Privacy Policy. Notwithstanding the Terms and our Privacy Policy, you consent to:

(a) receiving direct marketing material from each associated marketing agency (Shire Talk and/or Destination Shoalhaven);

(b) having your name published on our Website, in direct marketing material, on the App, and any social media pages if you are an eligible Giveaway Prize Winner;

(c) having your photo taken and utilised for marketing purposes if you are an eligible Giveaway Prize Winner, including but not limited to that photography being utilised in future direct marketing materials, on the Website, App, promotional materials, digital or otherwise; and

(d) any such photography of a Giveaway Prize Winner shall be the sole intellectual property of each associated marketing agency (Shire Talk and/or Destination Shoalhaven) and Giveaway Prize Winners shall have no claim, legal, moral, or otherwise in such intellectual property.

7.3. Each associated marketing agency (Shire Talk and/or Destination Shoalhaven) respects your right to privacy and takes the privacy rights of individuals and businesses seriously. For questions or concerns regarding our Privacy Policy or Giveaway Privacy Policy, collectively (the ‘Privacy Policies’), or to withdraw your consent to the terms and conditions of the Privacy Policies, please write to us at [email protected] specifically outlining your query or concern.

7.4. Please note, that in accordance with the Giveaway Terms and each associated marketing agency (Shire Talk and/or Destination Shoalhaven)’s Terms, a withdrawal of your consent to be bound by the Privacy Policies shall render you ineligible to participate in any draw or giveaway and may result in the suspension, cancellation, or limitation of your access to the Website, Service(s), the App, Membership, or your subscription at the sole discretion of each associated marketing agency (Shire Talk and/or Destination Shoalhaven).
